Welcome to www.theprojectpatchwork.com the official website (“Our Site”) for Project Patchwork for women living with hidden conditions (physical and mental chronic illnesses and aids). The following Terms and Conditions, along with the Forum Disclaimer and Privacy Policy serve as the agreement governing the members and visitors use of this Site. We may refer to Project Patchwork as “we”, “us”, “Site” or “Our Site” and to the member or visitor as “You” or “Your”. By using Our Site, either as a member or visitor, you are deemed to have accepted these Terms and Conditions, our Privacy Policy and the Forum Disclaimer. You also agree that you are 16 years of age or above.

USE OF SITE

Project Patchwork is a social forum for women suffering from hidden conditions (chronic illnesses, mental health and physical aids unseen by others). We enable you to create your own profiles to connect with other women just like yourself. We believe that support through connection with your equals improves your knowledge of your condition and mental wellbeing.

Project Patchwork is founded and operated by Wendy England, a previous chronic illness sufferer turned entrepreneur.

We hope you enjoy using this website as it is meant to provide you with kindness, support and safety while living with your hidden conditions.
You may only use Our Site in accordance with these Terms and Conditions, Privacy Policy, our Forum Guidelines and, in any event, for lawful purposes in compliance with all applicable laws, regulations and codes of practice in the UK or in any other jurisdiction from where you access Our Site. In particular, you agree not to access without authority, interfere with, damage or disrupt:
– any part of Our Site;
– any equipment or network on which Our Site is stored;
– any software used in the provision of Our Site; or
– any equipment or network or software owned or used by any third party.
In addition to providing you with information, the other purpose of Our Site include, membership, profile creation and forum access for members, allowing you to join our mailing list, connecting with other members, share real life experiences, place orders to purchase our products and services and provide a means for you to contact us. Any other use of this site is prohibited.
You agree not to use any features of this site that permit communications or postings to post, display, or otherwise communicate any of the following:
– any defamatory, threatening, obscene, harassing, or otherwise unlawful information;
– promote any discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
– infringe any copyright, database right, trade mark or any other right of any other person
– discussions enabling suicidal tendenies or distructive behaviours
– any advertisement, solicitation, or spam;
– any encouragement of illegal activity;
– unauthorized use or disclosure of private, personally identifiable information of others;
– advocate, promote or assist any unlawful act such as (by way of example only) any materials subject to trademark, copyright, or other laws protecting any materials or data of others in the absence of a valid license or other right to do so.
– any false or misleading information.

YOUR MEDICAL SUPPORT
People who may use this site must identify as a woman, non-binary or transgender as long as they were orginally born female. Why is this Site exclusively for women? Women have been, and still are, receiving less treatment and slower diagnosis times than men.
You may not register on someone else’s behalf or post for another. You agree that you will refrain from posting “medical advice”, instead you can post about what has supported you and why. We leave the medical advice to the professionals.
You will refrain from posting the names, positions or locations of medical professionals. What did or did not work for you may or may not work for someone else.
Our Site’s content, or any content on other sites linked to from Our Site, is never a substitute for professional medical advice. Even if another user appears to be a medical professional they are not in a position to undertake a physical examination or understand your full medical history. Therefore you should always speak to a doctor or other health practitioner about your condition and/or treatment or changes to your condition and/or treatment. In an emergency dial your local or national emergency telephone number. If support is need in a non-emergency see the associated Factsheets for the helpline numbers. Never delay seeking advice or dialling emergency services because of something that you have read on Our Site.

PRIVACY POLICY
If you use Our Site it is likely that this will involve sharing information about your health experiences. Due to Our Site being a membership only website your personal information on your profile is only viewable by other members. However, this may mean they can find you outside of Our Site. We recommend using anonymous, unique usernames although it’s important to understand that any information or experiences you share can carry the risk of revealing your identity to others. It is important that you understand how our data sharing relationships work and what information is shared with our different partners and users. REGISTRATION FOR MEMBERSHIP
You will not be able to use Our Site to it’s full extent unless you register as a member with us. By registering and becoming an account holder, you agree that we may provide you with information about Our Site (whether by email or any other medium) that we consider appropriate in accordance with our Privacy Policy.
When using Our Site, you accept that communication with us will be mainly in electronic format. We will contact you by email or provide you with information by posting notices on Our Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
You may opt-out of receiving these materials by emailing us to inform us that you wish to be removed from our contact list. This will subsequently remove you as a member from our site (without a refund) as we need to keep you informed of updates to our Terms and Conditions and Privacy Policy. You may still opt-out of marketing materials throughthe settings tab on your profile or by emailing our support team.
In order to register with us and become an account holder, you will be invited to provide a password, a user name and an email. You are entirely responsible for maintaining the confidentiality of your password and account. We will never ask for your password. If you forget your password, we may ask you to answer a specific question such as your username, date of birth or postcode. Furthermore, you are entirely responsible for any and all activities that occur under your account.
You agree to notify support@theprojectpatchwork.com immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for loss or damage incurred by us or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the express permission of the account holder. If you think that someone else has access to your password you should change it immediately.
YOUR USERNAME – You agree your username will not contain offensive words, inappropriate content, or be aggressive. Our values are based on kindness, support and safety and respect that you will bare this in mind when creating your username.
AVATAR – You agree your avatar will not include photos of someone who is not you or contains copyrighted material, medical/surgerical images or any offensive subjects. You agree your avatar will be appropriate for the Project Patchwork guidlines. You will only upload photos in which you are the copyright owner. You may use one of our exclusive avatar dolls instead of an image of yourself.

MEDICAL PROFESSIONALS
You agree, if you are a medical professional, you are registering for support for your personal health needs. You agree, as such, that you may not offer medical advice unless you are willing to provide full name, license information, contact information and assume all legal liability for posted content. Our Site encourages medical professionals to participate only as “women supporting women” and to be cautious in representing themselves as medical professionals. Members are here to feel less like a patient and more like a person.

SUPPORT ON THE FORUM THREADS
You agree to provide support from personal experience and respect members different ways of dealing with their health conditions. You may not ask the members to send email (or social media accounts) to you for support issues. You agree you will not list insurance companies, doctor names, addresses, phone numbers/websites/urls/social media links in the public forums. Recommendations for specific doctors/insurance should to be kept off of Our Site. You agree to keep discussions on topic within the correct thread. Discussions off topic may be removed without notice. You agree not to post messages or links that are obscene, profane, sexually explicit or descriptively graphic. Posts should have a tone of maturity and appropriate vocabulary at all times out of respect to other members.

OUR VALUES – KINDNESS, SUPPORT & SAFETY
YOU AGREE you will be kind and sensitive to other members at all times. YOU AGREE to support other members through every point of contact on Our Site. YOU AGREE to respect another members privacy by not asking for personal details, contact information, as such discussions on the forum threads that begin to reflect personal information (social media accounts, emails, medical/insurance documents, doctors/surgeons names) between members will be removed. Threads that begin with the purpose of finding members surgeons/doctors will be removed and asked to be kept off of Our Site.

SUICIDE MENTIONS/THREATS
As a member of Our Site you agree to not post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, threatening, invasive of a person’s privacy, or otherwise violative of any law. You agree that you will not make derogatory comments about any person based on religion, race, gender, condition, etc.
You agree that the moderators of Our Site may remove your post or close any thread containing a mention of a threat of suicide. If you are feeling suicidal you are encouraged to call 999 or go to your nearest hospital emergency room. For liability reasons, Our Site discourages personal contact with members posting suicide threats.

DISABLING/EDITING OF POSTS/USERS
You agree that the moderators of Our Site may edit/remove the posts and/or disable the account of any member who does not comply with the Terms and Conditions set out here or any reason deemed appropriate by the administration for the good of Our Site, its members and their safety. Requests for removal will entail removing personal data, location, avatar, forum posts and content to respect your privacy. If you decide to return to Our Site you will need to create a new account, username and profile. If you choose to cancel or do not renew your yearly membership – your profile will remain active for a period of 18 months after subscription end date unless yu express via email support@theprojectpatchwork.com that you wish all personal data to be removed earlier. This is to hold your forum threads, profile content, username etc incase you renew your membership before the period of 18 months has ended. Allowing you to continue with your discussions and keep your username.

PUBLIC DISAGREEMENTS WITH ADMINISTRATION/STAFF OR GUIDELINES
You agree that if you disagree with Our Sites Terms and Conditions, Privacy Policy or action of a member, you will not post public arguments or disagreements nor attempt to petition the owner/administration to change policy through posts, polls, email, PM or any other service found within Our Site. If you disagree, you may respectfully email our support team support@theprojectpatchwork.com

ADVERTISING/SOLICITATIONS/INTERVIEW/DATA GATHERING
You agree not to advertise website links (blog, personal facebook page, youtube, etc) in your signature, posts, PMs. You may add your website/social links to your profile in the appropriate place. You agree not to use the forum, membership list, PM, or profiles as a way to gather data, research, request interviews without permission of the owner of Our Site. To advertise or seek permission or additional information please email wendy@theprojectpatchwork.com

MEMBERSHIP FEES
Membership to Our Site is a yearly reoccurring fee of 29.99 GBP. We reserve the right to raise or lower this charge for the use of this Service in the future. We do not accept requests to lower the fee to meet other currencies. We charge a fee to keep Our Site functioning and safe for your use. This deters anyone who is not living with a hidden health condition, trolls, bullies, businesses, people who do not identify as being born female, from setting up an account so they may promote, extract, or judge your activities on Our Site.

REFUNDS
MEMBERSHIP – We DO NOT provide membership refunds. The only exception being if you have been over charged for a membership. If you no longer wish to stay on the site you may deactivate your account or email support@theprojectpatchwork.com who will deactivate your account for you. You understand in doing so you will forfeit your fee and if you wish to return to The fee allows us to stop fake or multiple profiles from being set up and maintain the integrity of Our Site and covers administration costs.
SHOP – When making a purchase through the shop – if the item is faulty we provide a refund within 30 days of receiving your item. You will be required to return the item at your own cost. Once received it will be checked for damage and either a new item sent out or a refund will be provided. If you email your proof of delivery to shopsupport@theprojectpatchwork.com we can also refund you the cost of returning to us. Without the proof of delivery we will be unable to provide the postage refund.
DIGITAL ARTWORK – We DO NOT provide refunds under any circumstances from the purchase of any digital artwork on Our Site.

INDEMNIFICATION
You agree to indemnify, keep indemnified defend and hold harmless Project Patchwork and it’s owner, its moderators, directors, employees, agents, suppliers and third party partners from and against all liabilities, losses, expenses, damages and costs, including reasonable legal fees, claims, demands and proceedings whatsoever, howsoever arising, resulting from or in connection with any violation by you of these Terms and Conditions, including, without limitation, the submission of any inaccurate or incorrect information.

THIRD PARTIES CONTENT
Our may provide links to third party websites (“Linked Sites”). If you choose to click on one of those links, you are leaving Our Site and you do so at your own risk. It is your responsibility to take all protective measures to guard against viruses or other destructive elements. Linked Sites, regardless of the linking form are not controlled by Our Site and cannot make any representations or warranties about the opinions expressed, nature, content, accuracy, security, completeness, or reliability of the information provided, or regarding the products or services provided on the Linked Sites. Links do not imply that Our Company sponsors or endorses the Linked Site. DISPUTE RESOLUTION
This Agreement is governed by and shall be construed in accordance with the laws of England; United Kingdom, without reference to its conflict-of-law provisions. You agree to submit to the personal and exclusive jurisdiction in England; United Kingdom for any disputes with Company arising out of your use of this site. You agree that if a dispute arises, parties will attempt to resolve the dispute with mediation in England; United Kingdom an online mediation service that is mutually agreed upon by all parties. The parties agree that their good faith participation in mediation is a condition precedent to pursuing other legal remedies. The successful party to any dispute resolution will be entitled to reasonable costs and fees incurred in resolving or settling the dispute, in addition to any other relief to which the party may be entitled.

SALE OR MERGER
If Our Site is sold to or merges with another company not owned by Wendy England, you should expect that some or all of the personal information collected from Our Site may be transferred to the buyer/surviving company. If so, we will seek to obligate the acquiring company to use any personal information transferred by Our Site in a manner consistent with our Privacy Policy, but you accept that the acquiring company will be responsible for use after the acquisition and that we cannot control this
If you do not wish the personal information you provide to be subject to this possibility, you should deactivate your membership by notifying deactivate@theprojectpatchwork.com and including “DEACTIVATE” in the subject line or by deleting your account in your account settings in Our Site

SEVERABILITY
If any term in this Agreement is found to be void or voidable, the remaining terms of the Agreement are unaffected, and deemed to remain in full force and effect, including those terms that are similar.

NO WAIVER
If we fail to enforce our rights under this Agreement or take action against any party for breach of this Agreement does not constitute a waiver of such rights, or of future subsequent enforcement of such rights. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with the methods specified above.

MODIFICATIONS TO AGREEMENT
We may revise this Agreement at any time. Your continued use of this site, our products and services serve as an agreement that you agree to be bound by the revised Agreement. Our Sites modifications will become effective on the date they are first posted to this website. Our Site does not have any obligation to notify you of changes to this Agreement. It is your responsibility to review the terms to apprise yourself of modifications.

ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to access to and your use of Our Site and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

LAW AND JURISDICTION
These terms and conditions and the agreement between you and us will be governed by English law. Any dispute arising from, or related to, these terms and conditions or our agreement shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

ASSIGNMENT OF RIGHTS
Your rights under this Agreement are not assignable.
